1. About ZAAG Intelligence

ZAAG Intelligence is a strength and conditioning application operated by Sanara Ltd, a company registered in England and Wales. The app uses artificial intelligence to generate training programmes, provide coaching suggestions, and track workouts. ZAAG Intelligence is not a medical device and does not provide medical advice. The service is designed for and marketed to users in the United Kingdom. You must be at least 18 years of age to use ZAAG Intelligence. By creating an account, you confirm that you are 18 or older.

2. Health and Safety Disclaimer

By using ZAAG Intelligence, you acknowledge and agree to the following:

• ZAAG Intelligence provides AI-generated training programmes and coaching suggestions for informational and educational purposes only. These do not constitute medical advice, physiotherapy, or professional personal training.
• You are required to complete the health screening questionnaire (PAR-Q) during onboarding as a condition of access. You agree to answer all screening questions honestly and accurately, and acknowledge that inaccurate responses may result in unsuitable programme recommendations. If your health circumstances change after completing the screening, you are responsible for updating your profile or consulting a medical professional.
• You should consult a qualified medical professional before starting any new exercise programme, particularly if you have pre-existing health conditions, injuries, or concerns about your physical fitness.
• You should consider working with a qualified personal trainer or strength and conditioning coach, especially when performing unfamiliar exercises or lifting heavy weights.
• You are solely responsible for your own health and safety during exercise. You undertake all physical activity at your own risk.
• AI-generated programmes may not account for all individual circumstances, medical conditions, or biomechanical limitations. You should modify or skip any exercise that causes pain or discomfort.
• Readiness scores, HRV analysis, and recovery recommendations are estimates based on limited data and should not replace professional medical assessment.

3. Limitation of Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

Subject to the above, Sanara Ltd, its directors, employees, and agents shall not be liable for any injury, loss, or damage of any kind arising from or in connection with your use of ZAAG Intelligence, including but not limited to injuries sustained during exercise, reliance on AI-generated recommendations, or any inaccuracy in readiness scores or training suggestions. This limitation applies whether the claim is based in contract, tort (including negligence), or any other legal theory.

4. Assumption of Risk

You acknowledge that physical exercise carries inherent risks, including but not limited to muscular, skeletal, and cardiovascular injury. By using ZAAG Intelligence, you voluntarily assume all such risks and agree that Sanara Ltd bears no responsibility for any adverse outcomes resulting from your participation in physical activity, whether or not such activity was suggested by the app.

5. Indemnification

You agree to indemnify and hold harmless Sanara Ltd and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the app, your breach of these terms, or your violation of any third party's rights.

6. User Accounts and Data

You are responsible for maintaining the confidentiality of your account credentials. Your training data, health metrics, and personal information are stored securely and processed in accordance with our Privacy Policy. Health and fitness data you provide (including health screening responses, injuries, biometric data from wearable integrations such as WHOOP and Oura, and body metrics) constitutes special category data under UK GDPR and is processed with your explicit consent given at registration. You may delete your account and all associated data at any time from the Settings page.

7. AI-Generated Content

Training programmes, coaching suggestions, and workout modifications are generated by artificial intelligence. While we strive for accuracy and safety, AI outputs may contain errors, inappropriate exercise selections, or unsuitable intensity recommendations. Always use your own judgement and stop any exercise that does not feel right.

8. Acceptable Use

You agree not to:

• Use ZAAG Intelligence for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to access other users' accounts or data, or interfere with the security or integrity of the service.
• Reverse-engineer, decompile, or attempt to extract the source code or AI prompts of ZAAG Intelligence.
• Use automated tools (bots, scrapers) to access the service without prior written permission.
• Resell, redistribute, or commercially exploit AI-generated programmes as your own coaching service without written agreement from Sanara Ltd.

9. Intellectual Property

All content, design, code, and AI models powering ZAAG Intelligence are the intellectual property of Sanara Ltd or its licensors. Training programmes generated for you are licensed for your personal use only. You retain ownership of your training data and may export or delete it at any time.

10. Termination and Suspension

We reserve the right to suspend or terminate your access to ZAAG Intelligence at any time if: (a) you breach these terms; (b) we reasonably believe continued use poses a health or safety risk (for example, if your health screening responses change materially); (c) your account is involved in fraudulent or abusive activity; or (d) at our discretion during any beta or early access period. Where possible, we will provide reasonable notice before suspension or termination. You may terminate your account at any time from the Settings page.

11. Changes to Terms

Sanara Ltd reserves the right to update these terms at any time. Continued use of ZAAG Intelligence after changes are posted constitutes acceptance of the revised terms.

12. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
